What can you do for me?
If you, a client, or a family member are facing the prospect of long-term imprisonment, I can likely provide a second "opinion" about the merits of an alternative sentence, or a mixture of confinement and alternative measures. I have qualified the above statement because, in some jurisdictions, a person may not be eligible for an alternative sentence due to mandatory penalties of imprisonment.
This is often useful because neither the government nor even the Probation office is performing this task. Therefore, the client is unable to present additional evidence about sentencing options or mitigating factors that may be pertinent.
Previous research has shown that in about 70% of the cases, the preparation of a sentencing or parole plan has positively impacted the final disposition [ see Footnote 209 ].
How are your services paid?
In general, I am retained via a private, fee-for-service contract. In a limited number of circumstances, I will accept legal aid but this is becoming more rare due to government cutbacks.
My fees vary depending upon the complexity of the case. For more specific information as well as a quote, you need to discuss the particulars with me, or send me some information about the case.
Can I hire you directly?
Yes you can, but the better procedure is to retain me through the client's attorney of record. My discussions with an attorney are protected from disclosure under the Solicitor-client privilege and various evidence statutes.
How long does this process take?
In general, the earlier you start, the more time is available to produce a quality evaluation. Research has shown that an early referral [ see Footnote 67 ] is associated with more positive dispositions. This is because alternative sentencing or parole work is very time-intensive and requires considerable paperwork, including a final report and, often, testimony.
A good rule of thumb is to give me a minimum of 4-6 weeks prior to the sentencing date or parole hearing date.
What happens if I am sentenced to prison anyway?
Frequently, my reports are used to help a prisoner with his or her designation to an institution as well as programming. If so requested, I am available to follow the client through the prison system, and assist them with their release plan, including any representation before the parole authority.
